Goffray fotos Limited release agreement

• I, (from here on known as the client), grants permission to Jeff Vuong (photographer) and agents, to take and use visual images of the agreed upon property listing. Visual images are any type of recording, including but not limited to photographs, digital images, or video recordings.

• I, (the client) will not materially alter the original visual images.

• The photographer grants permissions to (the client), and the rights to use images to promote the sale of the agreed upon property.

• In the event that the property listing agent changes or if the property is removed from current market, any photography provided by the photographer will not be transferred to the new agent and will not be used in the new listing without the written consent of the photographer.

• The property and any attached or detached dwelling units (ADU) will be photographed as is, on the scheduled day and time of the photo shoot.

• Any property NOT ready can be reschedule for a second photo shoot at full price. Any discounts will be at the discretion of the photographer. This term is non-negotiable.

• All rights to images created by the photographer will remain with the photographer. The photographer reserves the right to display any visual images made during the photography session, as samples of his work for the purposes of advertising, promotion on the internet, publication, instruction and professional competition.

• In the event of a date change or cancellation, any deposits paid will not be refundable. Client acknowledges that any prior amount of fees or deposits paid shall be liquidated.

• In the event of illness or other unforeseen circumstance, Jeff Vuong may substitute another competent, professional photographer to take the photographs.

• The client understands that if the client, home owner, home owner's pets and anyone associated causes damages to any of the photographer’s equipment in any way; the client, home owner, home owner's pets and anyone associated, will accept all responsibility. The client, home owner, home owners pets and anyone related, agree to pay in full, for repair or replacement of said damaged equipment. There will be no dispute on price of repair or replacement of said equipment that was damaged. This term is non-negotiable.

• The client understands that if unsafe property conditions causes any type of damages to the photographer’s equipment in any way, the client, home owner, or anyone associated, agrees to pay in full, for repair or replacement of said damaged equipment. The photographer will do their best to remain as safe as possible while conduction any photography services There will be no dispute on price of repair or replacement of said equipment that was damaged. This term is non-negotiable.

• If Jeff Vuong is unable to perform to the guidelines of this contract due to a fire or other casualty, act of God, act of terrorism or other cause beyond the control of the parties, Jeff Vuong shall have no further liability with respect to the agreement. If Jeff Vuong is unable to perform to the obligations in this contract for any other reason, Jeff Vuong will not be liable for costs in excess of the amount the client has paid. This limitation of liability will also apply in the event that the files are lost through camera malfunction, damaged in processing, lost in the mail, or otherwise damaged or lost with or without fault of the photographer. While every attempt is made to create the best images possible, no particular photo is guaranteed.
